Israel/Gaza: Implement Goldstone Recommendations on Gaza
UN Security Council Should Ensure Justice for Victims

(Geneva) - Israel, Hamas, and relevant United Nations bodies should promptly implement the recommendations of the UN fact-finding mission led by Justice Richard Goldstone on the recent Gaza war and bring to justice those responsible for serious violations of the laws of war, Human Rights Watch said today.

The Fact Finding Mission on the Gaza Conflict, established by the UN Human Rights Council, found that both parties to the conflict were responsible for serious violations of international human rights and humanitarian law, and that they committed war crimes and possibly crimes against humanity.

"The fact-finding mission's findings of serious violations by both Israel and Hamas are a significant step toward justice and redress for the victims on both sides," said Sarah Leah Whitson, Middle East director at Human Rights Watch. "Now the UN, and the Security Council in particular, need to act on these recommendations and ensure that justice is done."

Human Rights Watch particularly urged the US government not to stand in the way of the recommended Security Council action that would for the first time address the conduct of both Israel and Hamas. The Human Rights Council alone is no substitute for the Security Council because Israel has dismissed the council as biased and because the Security Council can refer the situation in Gaza to the International Criminal Court (ICC).

"The Obama administration's pronounced new principles for human rights in the Middle East will be put to the test," Whitson said. "Washington should welcome this opportunity for the Security Council to address the actions of both sides in this conflict."

The 575-page report, released on September 15, 2009, documented serious violations of international humanitarian law by Israel, with some incidents amounting to war crimes and possible crimes against humanity, including willful killings, deliberate attacks on civilian objects, wanton destruction of civilian property, indiscriminate attacks, the use of human shields, and collective punishment against Gaza's civilian population in the form of a continuing blockade.

The report also concluded that rocket fire from Gaza by Palestinian armed groups was deliberate and calculated to cause loss of civilian life and to terrorize Israeli civilians. As such, the mission concluded, they amounted to serious war crimes and perhaps crimes against humanity.

Human Rights Watch said the UN Security Council should implement the fact-finding mission's recommendation to establish a committee of experts to monitor if and how Israel and Hamas investigate alleged violations by their own forces. In the absence of good faith investigations after six months, the Goldstone report said, the Security Council should refer the situation in Gaza to the ICC.

Investigating and prosecuting laws-of-war violations are, first and foremost, the responsibility of the parties to the conflict, Human Rights Watch said. But both Israel and Hamas have dismal records of investigating and holding accountable members of their own forces for serious laws-of-war violations.

"The record gives little reason for confidence that Israel and Hamas will conduct serious investigations into credible allegations of laws-of-war violations by their own forces," Whitson said. "That's why a Security Council-appointed committee to monitor their actions is needed, to spur genuine investigations and prosecutions."

Human Rights Watch supported the fact-finding mission's call for the Security Council to refer the Gaza conflict to the ICC, should investigations by Israel and Hamas authorities remain inadequate.

"Security Council member states should take concrete steps to ensure justice for crimes committed by all sides during the Gaza conflict," said Whitson. "International justice should not be limited to prosecuting perpetrators from states that are more vulnerable to international pressure."

The ICC, the only permanent international criminal court, is the obvious international tribunal for war crimes committed during the Gaza conflict. Israel is not a party to the ICC, but the court would have jurisdiction over crimes committed during the Gaza conflict if the UN Security Council refers the situation to the ICC, if the ICC prosecutor acts positively on a declaration by the Palestinian National Authority requesting the court's authority over crimes committed in Gaza, or if nationals of ICC member states are found to have committed war crimes on behalf of one of the parties.

Human Rights Watch called on the ICC prosecutor to make a prompt legal determination on the Palestinian National Authority request, consistent with the ICC's mandate to end impunity.

The Fact Finding Mission on the Gaza Conflict was established by the UN Human Rights Council in January. The original mandate unfairly limited the investigation to Israeli abuses, but the council president subsequently expanded the scope to include an investigation of Hamas and other Palestinian armed groups, and the Human Rights Council acquiesced in that change when it was announced by the council president. Goldstone, an eminent international jurist and former chief prosecutor of the war crimes tribunals for the former Yugoslavia and Rwanda, led the mission, pledging to look at both sides.

The fact-finding mission said it conducted 188 individual interviews, and reviewed more than 300 reports and other documentation, in addition to more than 30 videos and 1,200 photographs.

Israel refused to cooperate and did not answer questions, ostensibly because it viewed the Human Rights Council and the initial resolution establishing the fact-finding mission as biased against Israel. However, Israel has refused to cooperate with other investigations into its recent conduct in Gaza as well, suggesting a desire to avoid scrutiny. It denied visas for Goldstone's team to visit Israel, so the mission invited Israelis to testify at public hearings in Geneva.

Hamas and Palestinian authorities in the West Bank cooperated with the mission, although the report noted "a certain reluctance by the persons it interviewed in Gaza to discuss the activities of the armed groups." Goldstone's team visited Gaza, via Egypt, in early June.

"The Human Rights Council has focused disproportionately on Israel in the past, but the Goldstone report rises above politics to examine abuses by both sides accurately and professionally," Whitson said. "Israel should welcome this positive evolution in the council's treatment of the Israeli-Palestinian conflict rather than to continue trying to avoid scrutiny of its conduct in Gaza."

Human Rights Watch has reported extensively on abuses by Israel and Palestinian armed groups during what Israel called "Operation Cast Lead" from December 2008 to January 2009. Hamas and other Palestinian groups violated the laws of war by firing hundreds of Qassam and Grad rockets into civilian areas in Israel, and by shooting those rockets from densely populated areas in Gaza. Israeli violations of the laws of war included firing white phosphorus munitions into populated areas, shooting civilians who were waving white flags to convey their civilian status, targeting civilians with drone-fired missiles, and unlawfully destroying civilian property.

(Genève, le 16 septembre 2009) - Israël, le Hamas et les organismes compétents des Nations Unies devraient rapidement mettre en œuvre les recommandations de la mission d'enquête de l'ONU conduite par le juge Richard Goldstone sur la récente guerre à Gaza, et traduire en justice les responsables de graves violations des lois de la guerre, a déclaré Human Rights Watch aujourd'hui.

La Mission d'établissement des faits sur le conflit de Gaza, mise en place par le Conseil des droits de l'homme de l'ONU, a conclu que les deux parties au conflit étaient responsables de graves violations du droit international humanitaire et des droits humains, et qu'elles avaient commis des crimes de guerre, voire éventuellement des crimes contre l'humanité.

« Les constatations par la mission d'enquête de l'ONU de graves violations tant de la part d'Israël que du Hamas constituent une avancée significative vers la justice et offrent aux victimes dans les deux camps l'espoir d'obtenir réparation », a déclaré Sarah Leah Whitson, directrice pour le Moyen Orient à Human Rights Watch. « L'ONU, et le Conseil de sécurité en particulier, doivent maintenant agir sur la base de ces recommandations afin de garantir que justice sera faite. »

Human Rights Watch a en particulier exhorté le gouvernement des Etats-Unis à ne pas faire obstacle aux recommandations adressées au Conseil de sécurité, puisque celles-ci portent sur des mesures qui pour la première fois aborderaient à la fois la conduite d'Israël et celle du Hamas. Le Conseil des droits de l'homme (CDH) ne peut être considéré comme un substitut du Conseil de sécurité dans cette affaire, d'une part parce qu'Israël a rejeté le CDH comme étant partial et d'autre part parce que seul le Conseil de sécurité est en mesure de renvoyer le dossier concernant Gaza à la Cour pénale internationale (CPI).

« Les nouveaux principes énoncés par l'administration Obama en matière de droits humains au Moyen Orient vont être mis à l'épreuve à la suite de la mission du juge Goldstone », a indiqué Sarah Leah Whitson. « Washington devrait saluer cette opportunité pour le Conseil de sécurité d'aborder les actions des deux parties lors du conflit à Gaza. »

Le rapport de 575 pages, publié le 15 septembre 2009, documente de graves violations du droit humanitaire international de la part d'Israël, et certains incidents équivalant à des crimes de guerre voire éventuellement des crimes contre l'humanité, notamment des meurtres intentionnels, des attaques délibérées contre des objectifs civils, la destruction arbitraire de propriétés civiles, des attaques indiscriminées, le recours à des boucliers humains et une punition collective contre la population civile de Gaza sous la forme d'un blocus prolongé.

Le rapport Goldstone a aussi conclu que les tirs de roquettes depuis Gaza par des groupes armés palestiniens étaient délibérés et calculés pour causer des pertes parmi les civils et terroriser les civils israéliens. Ainsi, a conclu la mission, ces tirs ont constitué des crimes de guerre graves voire éventuellement des crimes contre l'humanité.

Human Rights Watch a indiqué que le Conseil de sécurité de l'ONU devrait mettre en œuvre la recommandation de la mission d'établissement des faits relative à la création d'un comité d'experts pour vérifier si et comment Israël et le Hamas enquêtent sur les allégations de violations commises par leurs propres forces. En l'absence d'investigations de bonne foi dans un délai de six mois, a noté le rapport Goldstone, le Conseil de sécurité devrait renvoyer le dossier concernant Gaza à la CPI.

Mener des enquêtes et des poursuites judiciaires sur les violations des lois de la guerre relève, d'abord et avant tout, de la responsabilité des parties au conflit, a rappelé Human Rights Watch. Mais aussi bien Israël que le Hamas présentent un bilan déplorable en matière d'enquêtes et de poursuites concernant leurs propres forces pour des violations graves des lois de la guerre.

«L'expérience passée donne peu de motifs d'avoir confiance en la capacité du gouvernement israélien et du Hamas de mener eux-mêmes des enquêtes sérieuses sur les allégations crédibles de violations des lois de la guerre commises par leurs propres forces », a remarqué Sarah Leah Whitson. « C'est pourquoi un comité nommé par le Conseil de sécurité pour surveiller leurs actions à ce sujet est nécessaire, et inciterait les deux parties à entreprendre de véritables enquêtes et engager des poursuites judiciaires. »

Human Rights Watch a soutenu l'appel de la mission d'établissement des faits au Conseil de sécurité pour qu'il renvoie le conflit de Gaza à la CPI, dans le cas où les investigations par les autorités d'Israël et du Hamas seraient insuffisantes.

« Les Etats membres du Conseil de sécurité devraient prendre des mesures concrètes pour garantir la justice pour les crimes commis par toutes les parties durant le conflit de Gaza », a insisté Sarah Leah Whitson. « La justice internationale ne devrait pas viser uniquement les criminels qui sont citoyens d'Etats plus vulnérables qu'Israël ou le Hamas aux pressions internationales. »

La CPI, seule cour pénale internationale permanente, est le tribunal international tout indiqué pour les crimes de guerre commis durant le conflit de Gaza. Israël n'est pas un Etat partie à la CPI, mais la Cour serait compétente pour les crimes commis durant le conflit de Gaza dans trois cas de figure : si le Conseil de sécurité de l'ONU renvoyait ce dossier à la CPI, si le procureur de la CPI répondait positivement à la requête de l'Autorité nationale palestinienne en appelant à l'autorité de la Cour pour les crimes commis à Gaza, ou s'il s'avérait que des ressortissants d'Etats membres de la CPI ont commis des crimes de guerre au nom de l'une des parties.

Human Rights Watch en a appelé au procureur de la CPI pour qu'il prenne rapidement une décision sur la requête de l'Autorité nationale palestinienne, en accord avec le mandat de la CPI visant à mettre fin à l'impunité.

La Mission d'établissement des faits sur le conflit de Gaza a été mise en place par le Conseil des droits de l'homme de l'ONU en janvier. Le mandat d'origine limitait inéquitablement l'enquête aux exactions israéliennes, mais le président du conseil a par la suite élargi la portée du mandat pour inclure une enquête sur le Hamas et autres groupes armés palestiniens, et le Conseil des droits de l'homme a accepté ce changement lorsqu'il a été annoncé par le président du conseil. Le juge Goldstone, un éminent juriste international qui a servi comme procureur général pour les tribunaux jugeant les crimes de guerre en ex-Yougoslavie et au Rwanda, a dirigé la mission sur le conflit à Gaza, après s'être engagé à examiner les actions des deux parties belligérantes.

La mission d'établissement des faits a indiqué avoir mené 188 entretiens individuels et examiné plus de 300 rapports et autres documents, ainsi que plus de 30 vidéos et 1 200 photos.

Toutefois, Israël a également refusé de coopérer avec d'autres enquêtes sur ses actions récentes à Gaza, laissant supposer un désir d'éviter toute investigation. Israël a refusé des visas à l'équipe du juge Goldstone pour se rendre dans ce pays, aussi la mission a invité des Israéliens à témoigner lors d'audiences publiques à Genève.

Le Hamas et les autorités palestiniennes en Cisjordanie ont coopéré avec la mission, bien que le rapport ait noté « une certaine réticence de la part des personnes qu'elle a interrogées à Gaza pour aborder la question des activités des groupes armés ». L'équipe du juge Goldstone s'est rendue à Gaza, via l'Egypte, au début juin.

« Par le passé, le Conseil des droits de l'homme s'est concentré de façon disproportionnée sur Israël, mais le rapport Goldstone s'est situé au-delà du contexte politique pour examiner avec précision et professionnalisme les exactions commises par les deux camps », a conclu Sarah Leah Whitson. « Israël devrait se féliciter de cette évolution positive dans la façon dont le Conseil des droits de l'homme traite le conflit israélo-palestinien, au lieu de continuer à tenter d'éviter toute enquête sur sa conduite à Gaza. »

Human Rights Watch a largement rendu compte des exactions commises par Israël et les groupes armés palestiniens au cours de ce qu'Israël a appelé l'« Opération Plomb durci » de décembre 2008 à janvier 2009. Le Hamas et d'autres groupes palestiniens ont violé les lois de la guerre en tirant des centaines de roquettes Qassam et Grad sur des zones civiles en Israël, et en tirant ces roquettes depuis des zones fortement peuplées à Gaza. Les violations israéliennes des lois de la guerre incluaient des tirs de munitions avec du phosphore blanc sur des zones peuplées, des tirs sur des civils arborant des drapeaux blancs pour faire reconnaître leur statut de civils, des tirs sur des civils avec des missiles tirés depuis des drones aériens, et des destructions illégales de propriétés civiles.

(جنيف، 16 سبتمبر/أيلول 2009) – قالت هيومن رايتس ووتش اليوم إن إسرائيل وحماس وهيئات الأمم المتحدة المعنية، عليها جميعاً تنفيذ توصيات بعثة تقصي الحقائق بقيادة القاضي ريتشارد غولدستون، في تحقيقها الخاص بحرب غزة الأخيرة، مع تقديم المسؤولين عن الانتهاكات الجسيمة لقوانين الحرب للعدالة.

لجنة تقصي الحقائق الخاصة بنزاع غزة، وشكّلها مجلس الأمم المتحدة لحقوق الإنسان، انتهت إلى أن طرفيّ النزاع مسؤولين عن ارتكاب انتهاكات جسيمة للقانون الدولي لحقوق الإنسان والقانون الإنساني الدولي، وأنهما ارتكبا جرائم حرب، وربما جرائم ضد الإنسانية.

وقالت سارة ليا ويتسن، المديرة التنفيذية لقسم الشرق الأوسط وشمال أفريقيا في هيومن رايتس ووتش: "نتائج بعثة تقصي الحقائق الخاصة بالانتهاكات الجسيمة من قبل إسرائيل وحماس هي خطوة هامة نحو إحقاق العدالة وإنصاف الضحايا من الجانبين". وتابعت قائلة: "والآن على الأمم المتحدة، لا سيما مجلس الأمن، العمل بموجب هذه التوصيات لضمان إحقاق العدالة".

ودعت هيومن رايتس ووتش الحكومة الأميركية إلى عدم الوقوف في طريق تحرك مجلس الأمن للمرة الأولى للتصدي لسلوك إسرائيل وحماس على حد سواء. ومجلس حقوق الإنسان وحده ليس بديلاً عن مجلس الأمن؛ لأن إسرائيل قالت إن مجلس حقوق الإنسان متحيز، ولأن مجلس الأمن يمكنه إحالة الوضع في غزة إلى المحكمة الجنائية الدولية.

وقالت سارة ليا ويتسن: "مبادئ إدارة أوباما الجديدة لحقوق الإنسان المُعلن عنها في الشرق الأوسط ستخضع للاختبار". وتابعت قائلة: "على واشنطن أن ترحب بهذه الفرصة المتاحة لمجلس الأمن للتصدي لأعمال طرفي النزاع".

التقرير الذي جاء في 575 صفحة، وتم الإعلان عنه في 15 سبتمبر/أيلول 2009، يوثق الانتهاكات الجسيمة للقانون الإنساني الدولي من قبل إسرائيل، مع بعض الوقائع التي ترقى لجرائم الحرب وربما جرائم ضد الإنسانية، ومنها القتل العمد، وتعمد مهاجمة أعيان مدنية، والتدمير العشوائي لممتلكات المدنيين، والهجمات العشوائية، واستخدام الدروع البشرية، والعقوبة الجماعية ضد سكان غزة المدنيين على هيئة استمرار الحصار.

كما انتهى التقرير إلى أن إطلاق الصواريخ من غزة من قبل جماعات فلسطينية مسلحة كان متعمداً ومحسوباً لكي يسبب الضرر بأرواح المدنيين ويرهب المدنيين الإسرائيليين. ومن ثم، فقد انتهت البعثة إلى أن هذه الأعمال ترقى لكونها جرائم حرب جسيمة وربما جرائم ضد الإنسانية.

وقالت هيومن رايتس ووتش إن على مجلس الأمن أن ينفذ توصيات بعثة تقصي الحقائق بإنشاء لجنة خبراء لمراقبة ما إذا كانت إسرائيل وحماس تحقق في الانتهاكات المزعومة من قبل قواتها. وفي غياب التحقيقات بنية حسنة بعد ستة أشهر، حسبما قال تقرير غولدستون، فعلى مجلس الأمن إحالة الوضع في قطاع غزة إلى المحكمة الجنائية الدولية.

والتحقيق والمقاضاة فيما يخص انتهاكات قوانين الحرب، هو بالمقام الأول وبالأساس، مسؤولية أطراف النزاع، حسبما قالت هيومن رايتس ووتش. لكن إسرائيل وحماس لهما سجل مؤسف في التحقيق وتحميل أفراد قواتهم المسلحة المسؤولية عن انتهاكات قوانين الحرب الجسيمة.

وقالت سارة ليا ويتسن: "سجل التحقيق لدى الطرفين يترك لنا أقل الثقة في أن إسرائيل وحماس سيجريان تحقيقات جدية في المزاعم الموثوقة بوقوع انتهاكات لقوانين الحرب على يد قوات الطرفين". وأضافت: "لهذا فإن لجنة من تعيين مجلس الأمن تُكلف بمراقبة تحركات الطرفين هي إجراء مطلوب، وخليق بها أن تدفع بالتحقيقات والمقاضاة الجدية".

ودعمت هيومن رايتس ووتش دعوة بعثة تقصي الحقائق لمجلس الأمن بإحالة نزاع غزة إلى المحكمة الجنائية الدولية، إذا ما ظلت تحقيقات إسرائيل وسلطات حماس غير كافية.

وقالت سارة ليا ويتسن: "على الدول الأعضاء بمجلس الأمن أن تتخذ خطوات ملموسة لضمان العدالة في الجرائم المرتكبة من جميع الأطراف أثناء نزاع غزة". وأضافت: "ويجب ألا تقتصر العدالة الدولية على مقاضاة الجناة من دول أكثر ضعفاً في مواجهة الضغوط الدولية".

والمحكمة الجنائية الدولية، المحكمة الجنائية الدولية الدائمة الوحيدة، هي محفل التقاضي الطبيعي لجرائم الحرب التي تم ارتكابها في غزة. وإسرائيل ليست طرفاً في المحكمة، لكن المحكمة سيكون لها اختصاص النظر في الجرائم المرتكبة أثناء نزاع غزة إذا أحال مجلس الأمن الوضع إلى المحكمة، وإذا تحرك مدعي المحكمة بشكل إيجابي فيما يخص إعلان من السلطة الوطنية الفلسطينية تطلب فيه اختصاص المحكمة في الجرائم المرتكبة في غزة، أو إذا تبين ارتكاب مواطنين لدول أطراف في المحكمة الجنائية الدولية لجرائم حرب أثناء النزاع بالنيابة عن أي من الطرفين.

ودعت هيومن رايتس ووتش ادعاء المحكمة الجنائية الدولية إلى حسم الموقف القانوني لطلب السلطة الوطنية الفلسطينية على وجه السرعة، بما يتفق مع ولاية المحكمة بوضع حد للإفلات من العقاب.

بعثة تقصي الحقائق الخاصة بنزاع غزة تم تشكيلها من قبل مجلس حقوق الإنسان في يناير/كانون الثاني. الولاية الأولى للبعثة حدّت من التحقيق بحيث يقتصر على الانتهاكات الإسرائيلية، لكن فيما بعد وسع رئيس المجلس من مجال الولاية ليشمل التحقيق في أعمال حماس وغيرها من الجماعات الفلسطينية المسلحة، فقبل مجلس حقوق الإنسان بالتغيير حين أعلن عنه رئيس المجلس. غولدستون، القاضي الدولي المعروف وكبير الادعاء السابق في محاكم جرائم الحرب الخاصة بيوغسلافيا السابقة ورواندا، تزعم البعثة، وتعهد بالنظر في انتهاكات الطرفين.

بعثة تقصي الحقائق قالت إنها أجرت 188 مقابلة فردية، وراجعت أكثر من 300 تقرير ووثائق أخرى، بالإضافة إلى أكثر من 30 تسجيل فيديو و1200 صورة فوتوغرافية.

ورفضت إسرائيل التعاون ولم تجب على الأسئلة، بدعوى أنها ترى مجلس حقوق الإنسان وقراره الأوليّ المنشئ لبعثة تقصي الحقائق متحيزاً ضد إسرائيل. إلا أن إسرائيل رفضت التعاون مع تحقيقات أخرى في سلوكها في غزة أيضاً، مما يوحي برغبة في تفادي التدقيق في سجلها. ورفضت منح تأشيرات دخول لفريق غولدستون في زيارته لإسرائيل، فدعت البعثة الإسرائيليين إلى الشهادة في جلسات عامة في جنيف.

وتعاونت حركة حماس والسلطة الفلسطينية في الضفة الغربية مع البعثة، رغم أن التقرير أشار إلى "تردد من قبل الأفراد الذين قابلناهم في غزة عن مناقشة أنشطة الجماعات المسلحة"، وزار فريق غولدستون غزة عبر مصر في مطلع يونيو/حزيران.

ישראל/עזה: יש ליישם את המלצות ועדת גולדסטון בנושא רצועת עזה

(ירושלים) - ארגון אמר היום כי על ישראל, חמאס ומוסדות או"ם ליישם לאלתר את המלצות הוועדה לבדיקת העובדות של האו"ם בראשותו של השופט ריצ'רד גולדסטון בנוגע למלחמה בעזה ולהעמיד לדין את האחראים להפרות חמורות של דיני המלחמה.

הוועדה לבדיקת העובדות בנוגע לעימות ברצועת עזה, שהוקמה על-ידי מועצת זכויות האדם של האו"ם, מצאה כי שני הצדדים לעימות נושאים באחריות להפרות חמורות של משפט זכויות האדם הבינלאומי ושל המשפט ההומניטארי הבינלאומי, וכי הם ביצעו פשעי מלחמה וייתכן שאף פשעים נגד האנושות.

הוועדה לבדיקת העובדות הודיעה כי קיימה 188 ראיונות פרטיים, ובחנה למעלה מ-300 דו"חות ומסמכים אחרים, וכן למעלה מ-30 קטעי וידאו ו-1,200 תמונות.
